Standard After market Product Warranty Policy (For Commercial Truck and Trailer Products) Revised January, 2004

Haldex Commercial Vehicle Systems (hereinafter referred to as Haldex) warrants to the original end user that all Haldex Products will be free from defects in material and workmanship. The Warranty shall be extended from original in-service date to the limits shown in the chart below.

WARRANTY SPECIFICATIONS

Reminder: None of the above products are warranted against misapplication, improper installation or normal wear and tear.

¹    Linehaul type applications.

²    With caging tool hole dust plug. Warranty will be limited to 24
Months, if dust plugs are missing.

³    Severe duty type applications (ie. P&D, Construction, Refuse,
Concrete Mixers, Off-Highway, Etc.)

⁴    Inlet pressure must not exceed 25 psig (50" Hg).

⁵    Inlet pressure must not exceed 35 psig (50" Hg).

⁶    Warranty is void if: misapplication; friction material worn to
rivets; burned facing or pressure plate; ceramic converted to
organic.

⁷    Friction products are warranted for the reasonable life of the
lining material. This varies significantly by product and appli­
cation. Warranty is void if misapplication or if product is
riveted or bonded. Riveted - worn down to but not contacting
rivets. Bonded - worn to one-third (1/3) of original thickness.

⁸     Applicable to new service part numbers only.

⁹     Refuse Trucks - 24 Months/200,000 Miles.
Transit Bus/Coach - 36 Months/300,000 Miles.
On-Highway Tractor/Trailer - 60 Months/500,000 Miles.

¹⁰      Includes 14" - 15.5" Clutch Discs supplied in any "RC" or
"MU" Haldex Remanufactured Clutch Pack.

¹¹       Compressor inlet pressure must not exceed 5 psig (10" Hg).

Warranty Policy Terms and Conditions

Haldex, at its option will replace or issue a credit at Aftermarket Net acquisition cost of any unit determined to be defective. Said determination will be performed by Authorized Haldex Warranty Representatives. Parameters of determination will include, but not necessarily be limited to: Unit shall be within the specified time limitations and must have been installed and maintained in accor­dance with accepted industry practices.

This Warranty Policy will not apply if, in the judgement of Haldex the unit(s) or part(s) thereof have been subject to damage by accident, fire, misuse, or negligence, repair or alterations by anyone other than Haldex or its authorized representative, or if Haldex serial numbers affixed to the unit(s) or part(s) are removed, obliterated or defaced. Any defect should be brought immediately to the atten­tion of the original purchaser and the unit(s) or part(s) claimed to be defective shall be returned to Haldex. The liability under this Warranty Policy shall not exceed purchase price paid.

Haldex reserves the right to make changes in the design of, additions to, or improvements in its products without incurring any obligation to modify or make similar changes on products previously manufactured or sold. Haldex does not authorize any other company or person to assume for it any warranty or other liability or obligation with respect to Haldex Products.

This Warranty Policy does not cover failure of a product due to a defect in the design, plans or specifications of such product where such design, plans or specifications were supplied to Haldex by Buyer or by another person on Buyer's behalf.

This Warranty Policy does not cover claims for "serviceable" items such as filters, service diaphragms and desiccant cartridges or similar (but not limited to these) items unless there is a clear indication of a defect in workmanship or material.

This Warranty Policy does not cover claims for products where failure is caused by "lack of servicing or maintenance of the product."

This Warranty Policy does not cover claims for air dryers where the desiccant cartridge is found to be "heavily contaminated" with oil.

This Warranty Policy does not cover claims on air valves or hydraulic valves where evaluation shows the ingestion of foreign material into the valve. This includes liquids, solid material and alcohol-based products.

This Warranty Policy does not cover claims for corrosion and/or the ingestion of foreign material, which is detrimental to the proper function of sealed spring brakes and unless it is determined to be assignable to a defect in material or workmanship by Haldex.

This Warranty Policy does not cover claims for large amounts of foreign material ingestion into the spring cavities of unsealed actuators as a normal result of operation. Claims for small amounts of foreign material ingestion into the spring cavities of unsealed actuators will be considered under this Warranty Policy.

Haldex is not responsible for "down time" expenses, cargo damage or any other business costs or losses resulting from failure or use of Haldex Products.

Haldex is not responsible for claims that are not returned to Haldex within thirty (30) days from the failure date.

This warranty does not cover products that are mis-installed or where mis-application is diag­nosed.

This warranty does not cover wires that are pinched during installation or where wires are not installed as recommended by Haldex.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND ALL OTHER OBLIGATIONS OR LIABILITIES, INCLUDING LIABILITY FOR INCIDENTAL, SPECIAL, CON­SEQUENTIAL DAMAGES OR LABOR.
